Terms Of Service

General:
Clients must be 18 or more years old to use any of myforexvps.co.uk services. Persons under the age of 18 are not permitted to purchase services from myforexvps.co.uk. Failing to meet this criteria may result in immediate account termination.

Customers acknowledge that all services provided by myforexvps.co.uk are self-managed by the Customer. myforexvps.co.uk will not configure or secure VPS/Servers onbehalf of the customer. Howver, if requested during checkout we will install on the hosting clients behalf your trading platform as offered by our new account setup policy.

Customers are responsible for ensuring that all content on their VPS/Server/Domain is not, at any time, prohibited on our network as described in this page below.

Content:
myforexvps.co.uk prohibits the following content on its network:

• Copyrighted media, without authority to distribute or display(warez)
• Unlicensed applications, Cracking programs or key generators
• Child pornography or kidnapping material
• Adult (nudity,pornography) material
• Fraudulent activity, phishing or impersonation
• Terrorist propaganda, racist material, or bomb/weapon instructions
• Virus/Virii, Spyware, Malware, or other infectious material
• Material protected by trade secret or other statute
• Scripts commonly used for abuse, attacks, or flooding
• Threatening, harrassing, or obscene content
• HYIP and low investment high profit schemes
• Banking websites or shipping websites

Activities:
myforexvps.co.uk prohibits the following activities on its servers:

• Denial of Service Attacks (DOS/DDOS)
• IRC and associated programs (including psybnc, "bots", etc...)
• Unnecessary Port Scans
• Mail Bombing
• Unsolicited Advertising via IM, Forums, Newsgroups, Email, etc..
• File sharing services/downloads/dvdrip/mp3s/torrents/P2P
• Game Servers on VPS (Allowed on Dedicated Servers)

Links to such content or activities are also prohibited.

Bulk Mail :
No bulk mail sending is permitted from our servers. Failure to comply may lead to instant deactivation.

Payments:
Invoices are sent out by email upon generation 5 days before due dates. Myforexvps.co.uk cannot guarantee email delivery. The client is responsible for ensuring their account is kept up to date at all times to prevent service suspension or cancellation. Orders may be canceled if no payment is received multiple days past invoice due dates.

Suspension/Deactivation:
If any terms or conditions are failed to be followed, the client risks service suspension or termination. myforexvps.co.uk reserves the right to remove any account, without prior notice. If myforexvps.co.uk deactivates an account for violating policy, the client will forfeit any rights to a refund. No refunds for advance payments will be granted for deactivated accounts.

Reactivation:
If a service is suspended, the client may be required to pay a reactivation fee of £20.00, and when applicable, to cover any administrative costs associated with the offense/violation, as determined by myforexvps.co.uk

Cancellation:
After a client's account is canceled, all data is removed permanently. No data backups are stored by myforexvps.co.uk on the servers. Client agree's that myforexvps.co.uk are in no way responsible for loss of data due to cancellations either due to network abuse, non payment or cancellation requests.

Data Transfer :
Data Transfer limits for your VPS/Server package are clearly described on the website before purchasing. Data Transfer is billed from the first day to the last day of each month. myforexvps.co.uk will provide access for customers to view their usage 24/7 online. Customers are responsible for their own usage and making certain they do not exceed their package limit to avoid data transfer overage fee's. Customers are not notified of their data transfer usage. The current overage fee for each GB over their allocated limit is £0.35.

Data Backups : 
myforexvps.co.uk does not offer a range of data backup services for its clientele. Customers must make their own backups in case of hardware failure resulting in data loss. Myforexvps.co.uk are not responsible for any data loss of any clients. We provide an instant reinstall servicec in the event that your server become unusable. Your trading records via metatrader are normally available from your broker.

Abusive Clientele: 
myforexvps.co.uk may at it's discretion suspend or terminate service of any client that is abusive/harassing to myforexvps.co.uk and/or myforexvps.co.uk employees. Examples of such activity include, but are not limited to;

• Verbal abuse - cursing, yelling, threatening, etc...Ongoing disregard for warnings or notices
• Consistent mistakes/errors/changes causing unnecessary workload
• Spamming myforexvps.co.uk email addresses, ticket systems, or servers
• Continuous involvement in flood/DDOS activity, hacked services, or other prohibited usage
• Consistent late payments or responses
• Continuous activation of problematic end-users
• Activity which affects the service(s) of other myforexvps.co.uk clientele

Refunds:
All sales are final. myforexvps.co.uk may provide a full refund to customers within the first 14 days of use if myforexvps.co.uk fail to provide services as described on the myforexvps.co.uk website. Only Credit card or Paypal payments are refunded. Any other form of payment is non refundable.

• data backup services
• Reactivation fee as a result of service suspension

Internet/VPS Trading Risks
There are risks associated with utilizing an Internet/VPS-based deal execution trading system including, but not limited to, hardware malfunction, software failure, and Internet connection problems. myforexvps.co.uk will strive to maintain a consistent connection and uptime however the Customer agrees to hold harmless Market Systems Limited, it's employees, agents, resellers and providers for any disruptions or subsequent losses resulting therefrom.

Disclaimer:
USE OF THE COMPANY'S SERVICES AND PRODUCTS IS AT CUSTOMER'S SOLE RISK. NEITHER THE COMPANY NOR ITS EMPLOYEES, AGENTS, RESELLERS THIRD PARTY INFORMATION PROVIDERS, MERCHANTS LICENSERS OR THE LIKE, MAKE ANY WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, THAT THE COMPANY'S SERVICES AND PRODUCTS WILL NOT BE INTERRUPTED OR BE ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MIGHT BE OBTAINED FROM THE USE OF THE COMPANY'S SERVICES AND PRODUCTS OR AS TO THE ACCURACY, OR RELIABILITY OF ANY INFORMATION SERVICE OR MERCHANDISE CONTAINED OR PROVIDED THROUGH THE COMPANY'S SERVICE, UNLESS OTHERWISE EXPRESSLY STATED IN THIS AGREEMENT. THIS INCLUDES LOSS OF DATA, WHETHER RESULTING FROM DELAYS, ON DELIVERIES, WRONG DELIVERY, AND ANY AND ALL SERVICE INTERRUPTIONS CAUSED BY THE COMPANY AND ITS EMPLOYEES OR OTHER CAUSES.

THE SOLE CUMULATIVE LIABILITY OF THE COMPANY FOR ALL CLAIMS MADE BY THE CUSTOMER, OR ANY OTHER PARTY, REGARDLESS OF FORM, INCLUDING ANY CAUSE OF ACTION BASED ON CONTRACT, TORT OR STRICT LIABILITY, SHALL NOT EXCEED THE TOTAL AMOUNT OF ALL FEES AND CHARGES PAID TO THE COMPANY BY THE CUSTOMER DURING THE 30 DAYS IMMEDIATELY PRECEDING THE DATE ON WHICH A CLAIM MAY ACCUR.

Foreign Exchange Trading Risks
Trading foreign exchange carries a high level of risk, and may not be suitable for all investors. The high degree of leverage can work against you as well as for you. Before deciding to invest in foreign exchange you should carefully consider your investment objectives, level of experience, and risk appetite. The possibility exists that you could sustain a loss of some or all of your initial investment and therefore you should not invest money that you cannot afford to lose.
